Family Health Insurance Regulations in New Jersey (NJ):

  • All insurance companies in New Jersey must offer standardized plans (HMO, PPO, etc.). Furthermore, these insurance companies are mandated by the state to charge the same premiums to everyone for both individual and group plans.

  • Small businesses are able to purchase group insurance plans for employees, but self-employed individuals do not have this option.

  • Individual insurance companies are not able to turn down any individual for coverage in the state of New Jersey, and policies may not be cancelled when a policyholder becomes sick.

  • Companies may examine medical records as far back as 6-months to determine whether or not a condition is pre-existing. However, the maximum exclusion period for pre-existing conditions for group plans in only 6 months.

  • In New Jersey, pregnancy is considered a pre-existing condition but any complications during delivery will be covered.

  • New Jersey also provides its NJ FamilyCare program, which helps financially eligible families obtain health insurance to cover the cost of routine physician visits, prescriptions, hospitalizations, lab tests, x-rays, eyeglasses for families and dental care for most children and for some adults.
