Family Health Insurance Regulations in Illinois (IL):

  • Insurance companies in Illinois have a right to turn down individuals for individual coverage due to a medical illness. Insurance companies may see medical records for the previous 24-month period prior to application.

  • For group plans, insurance companies may see medical records for the previous 12 months, but may only exclude coverage of pre-existing conditions for 6 months after that, or 18 months in the case of late plan enrollees.

  • In Illinois, pregnancy can be considered a pre-existing condition.

  • Illinois does provide a state-funded high risk insurance pool, the Illinois Comprehensive Health Insurance Plan (ICHIP), for individuals and their families previously denied coverage because of pre-existing medical conditions. ICHIP does not have an annual benefit limit, but it does cap lifetime benefits at $1,000,000. There is also an enrollment cap, and a variable waiting period based on the selected plan.

  • Illinois offers Medicaid and KidCare to help low-income families and pregnant women, in addition to programs offering financial assistance.
